On Which Days Is Confession Not Recited During the Bedtime Shema?
Question
Shalom, honored Rabbi,
On which days is the confession recited during the bedtime Shema, and on which days is it not?
Respectfully,
Omer Giz
Answer
Greetings,
On all days when we do not say Tachanun in prayer, such as Shabbat, Rosh Chodesh, and throughout the month of Nisan (the days when Tachanun is not recited are detailed in the prayer book before the Tachanun prayer) - we do not say confession during the bedtime Shema. Additionally, on the evenings following all of these days, one who sleeps before midnight does not say confession during the bedtime Shema.
Sources: Thus wrote Rabbi Chida zt"l in Machuza Brachah (Siman 5, Sif 36) in the name of Rabbi Meir Zarchi in his responsa, Siman 30, as received from the Ari zt"l. See also Rabbi Chaim Palagi zt"l in Kaf HaChaim (Siman 32, Sif 64) who wrote in the name of Chesed LeAlafim that the law is the same on the evening following Rosh Chodesh and Chanukah.
With blessings,
Rav Hillel Meirs
