Is Coitus That Is Not in the Usual Manner Prohibitive for a Woman's Husband?

AA

Question

I got divorced a few months ago. During the divorce period, I met a man, and unfortunately, we did not maintain physical separation, but we were careful not to engage in sexual intercourse. My question is - does anal intercourse count as sexual relations? If so, what is the ruling? Please respond to me in detail.

Answer

Greetings,

1. A woman who has committed adultery with a man while married is prohibited, even after her divorce, to marry that man with whom she had illicit relations (Shulchan Aruch, Even HaEzer 178:17).

2. Similarly, a woman who has committed adultery with a stranger while married, and they had relations that were not in the usual manner, is also prohibited from marrying that man even after her divorce (Rama there, 240:1).

3. However, if the aforementioned relations occurred after you received a get from your previous husband, then it is as if you were no longer a married woman at that time, and in such a case, you are not prohibited from that person with whom you had relations (despite the very serious prohibition involved), and you may marry him.

Best wishes,

Hillel Meirs
