Is it permissible to engage in relations during the day?
Question
Hello esteemed Rabbi,
I wanted to ask if it is permissible to engage in relations during the day? I understand this is bold, but I wanted to ask if it prohibits and why it is considered bold?
Thank you very much
Answer
Greetings,
One should not engage in relations during the day because it is not in accordance with the ways of modesty, and it is mentioned that this is considered boldness. However, it is permissible to engage in relations in a dark room.
Sources: This is indeed stated in the Shulchan Aruch, Orach Chaim (Siman 251, Seif 11) that one should not engage during the day unless it is in a dark room. The Mishnah Berurah (S"k 44) writes that the reason for the prohibition is that it is not the way of modesty. However, the Shulchan Aruch, Even HaEzer (Siman 25, Seif 5) writes that it is inappropriate to engage during the day as it is considered boldness.
It is further clarified in the Rama, Orach Chaim there, that a Torah scholar can cover himself with his tallit and it is permissible. The Mishnah Berurah (S"k 43) notes that in any case, one should not be lenient in this matter unless there is a significant need, meaning when one’s yetzer (desire) overwhelms him. See also Sha'ar HaTziyun (S"k 28) that when one’s desire overcomes him and he could potentially, Heaven forbid, come to sin, it is permissible through covering oneself with a Tallit for any person. See also Responsa Mishnah Halakhot, Part 11 (Siman 196) and Responsa Viyane David, Part 2 (Siman 185-196).
