Child Born Without Marriage and Its Status as a Mamzer

AA

Question

Hello, I would like to clarify whether children born to Jewish couples who are married through civil marriage are considered mamzerim? And if a couple becomes pregnant without marriage, but gets married according to halacha before the birth, is that child also considered a mamzer? Thank you

Answer

Greetings,

Children born to a couple that married through civil marriage are not considered mamzerim. Additionally, a child born to a woman who became pregnant without a chuppah and kiddushin is not a mamzer, even if they did not have a chuppah and kiddushin before the birth (see Shulchan Aruch, Even HaEzer, Siman 4, Seif 13).

Best regards,

Hillel Meirs
