Defense Minister Asks Israel's President to Erase Elor Azaria's Criminal Record

Defense Minister Israel Katz has asked President Isaac Herzog to erase former soldier Elor Azaria's criminal record, despite opposition from the IDF.

Defense Minister Israel Katz submitted a request today (Tuesday) to President Isaac Herzog to erase the criminal record of former IDF soldier Elor Azaria. Before submitting the request, Katz sought a legal opinion from the IDF, which announced that it opposes erasing Azaria's criminal record.

Katz's request is intended to shorten the waiting period before Azaria's criminal record can be erased, after he completed his prison sentence and the statute of limitations in his case expired. The defense minister emphasized Azaria's service as a combat soldier and his efforts to rebuild his life.

"It is hard to justify the continued harm to his ability to fully integrate into society, work, and earn a living," Katz said. "It is unreasonable that, after a decade, an outstanding soldier who was convicted of an offense committed during his operational service should continue to pay such a heavy price."

Katz said consideration should be given to Azaria's service as an outstanding combat soldier and combat medic in the Kfir Brigade, the operational circumstances surrounding the incident, the significant personal, family, and public price he has paid over the years, and his efforts to rehabilitate himself, build a family, and return to the workforce.

According to a report by Channel 14 News, Katz also wrote in his appeal that "many years have passed since the incident, during which the State of Israel experienced the murderous October 7 terrorist attack and its severe consequences. These events have underscored the brutal nature of the Palestinian terrorist ideology that Israel is confronting, and the way our enemies act with the intention of murdering civilians and soldiers without any moral restraint."

He added: "This reality provides broader context for the circumstances in which IDF soldiers have operated over the years against cruel and unrestrained enemies. At the same time, in recent years hundreds of terrorists have been released from Israeli prisons as part of agreements to secure the return of our kidnapped brothers and sisters. Under these circumstances, and after Elor has fully served the sentence imposed on him, it is difficult to justify the continued harm to his ability to fully integrate into society, work, and earn a living."

"This is not about erasing what happened," Katz concluded. "It is about giving effect to the principle of rehabilitation after many years in which he bore the consequences of his actions, in a manner that reflects the circumstances of the case and the passage of time."
