Is it permissible to sit in the sukkah on Simchat Torah?

Question

Am I allowed to sit in the sukkah on Shemini Atzeret and invalidate it? Because we have no other place to host except the balcony. Thank you

Answer

Greetings,

It is prohibited to sit in the sukkah on Simchat Torah. However, if you leave a gap of four handbreadths (approximately 32 cm) in the sukkah's covering before the onset of Simchat Torah, you will be able to sit in the sukkah on Simchat Torah, as this indicates that the sitting is not for the purpose of fulfilling the mitzvah of sukkah, and it will not appear as if you are adding to the commandments.

Sources: Shulchan Aruch Orach Chaim (Siman 669).

Blessings,

Hillel Meirs
