A Woman Who Divorced and Engaged in Relations with Another Man: Is She Permitted to Remarry Her Ex-Husband?
Question
Hello, honored Rabbi, I divorced two years ago, and I tried my best to keep away from physical contact since the divorce, but about a week ago I failed and had relations with another man. If I want to return to my ex-husband, am I permitted to remarry him? Thank you very much for your kind and helpful service.
Answer
Greetings,
You are permitted to remarry your ex-husband (of course, only if he is not a kohen, because if he is, he is forbidden to marry a divorced woman, even if she is his former wife).
Sources: For indeed, a woman who divorced and married another man, and then divorced from him as well, is prohibited from remarrying her first husband. However, if she divorced and then committed adultery (had relations with another man without marriage), it is permitted for her to return and marry her first husband, as explained in the Shulchan Aruch, Even HaEzer (Section 10, Paragraph 1).
Wishing you blessings and success,
Hillel Meirs
