Is a penguin kosher to eat, and why?

Indeed, the penguin is a type of bird.
The Torah gave a list of the types of birds that are forbidden to eat, but we do not know how to identify them all. Therefore, one does not eat a bird regarding which there is no clear tradition that it is permitted.
Although there is no clear tradition regarding it, we can observe that the penguin, unlike kosher birds, is a hunting creature (one that catches fish). In principle, the Torah forbade all predatory, flesh-eating animals, including the eagle and the vulture. Therefore, it is logical to assume that the penguin too is an impure bird.
