Kirk’s widow, Erika, his parents, and Donald Trump Jr., the son of President Donald Trump and a close friend of Kirk, were present in the courtroom before Judge Tony Graf.
CNN reported that, at this initial stage, the proceedings are expected to last several days. Prosecutors will present evidence, and after the hearings the judge will decide whether there is sufficient evidence to allow the case to proceed to trial. Even before the proceedings began, prosecutors announced that they would seek the death penalty if Robinson is convicted.
Kirk, who was 31 at the time of his death, was shot and killed on September 10, 2025, while speaking before a crowd of about 3,000 people at Utah Valley University. Robinson, an electrical apprentice, fled the scene and was apprehended the following day with the help of his father, who suspected that his son was involved in the murder and notified police of his whereabouts.
Among the evidence prosecutors are expected to present is security camera footage from the scene documenting Robinson’s escape, a note he left in his apartment that read, “I have an opportunity to eliminate Charlie Kirk and I’m going to take it,” and an alleged confession in a chat with his friend.
Prosecutors said on Monday that Robinson instructed his friend to delete the correspondence and remain silent during questioning. The friend, who received immunity in exchange for giving a recorded statement to police, is considered a key witness. The defense’s request to disqualify his testimony was rejected by Judge Graf.
In addition, a DNA profile matching Robinson was found on the weapon discovered abandoned in a grove near the scene, a Mauser sniper rifle, as well as on the spent shell casings, on unfired bullets engraved with messages, and on the towel that had been wrapped around the rifle.
